On 25 October 2024 the Court of Appeal gave a milestone judgment in Afriyie v Commissioner of Police for the City of London [2024] EWCA Civ 1269.  Mr. Afriyie successfully appealed to the trial judge, Hill J, who ruled that the police had acted lawfully when tasering him.   However, the Court of Appeal (comprising Lady Chief Justice Carr, Dingemans and William Davis LJ) reversed the judge’s ruling- laying down some fundamental principles to control how the police must use tasers.  Tasers are of course firearms as defined by the Firearms Act 1968 and the Court of Appeal have now for the first time grappled with the dangers they pose.
